What is Boating While Intoxicated?
According to Texas Penal Code 49.06, a person commits the crime of boating while intoxicated (BWI) if he or she is intoxicated while operating a watercraft. Under Texas law, the term “intoxicated” is defined as “not having the normal use of mental or physical faculties because of the use of alcohol, a controlled substance, a drug, a dangerous drug, or any other substance into the body.” An individual can also be considered intoxicated if they have a blood, breath, or urine alcohol concentration (BAC) of .08% or greater.
First-offense BWIs are classified as class B misdemeanors. A class B misdemeanor in Texas is punishable by up to $2,000 in fines and up to 180 days in jail. If an alleged offender registers a BAC of 0.15 or higher, they can be charged with a class A misdemeanor punishable by up to $4,000 in in fines and up to 1 year in jail.
